摘要:  
  在日俄勢力進入中國東北以前,馬賊已是中國地方政府鎮撫重點。關於馬賊與日本關係,既有研究大多關注兩者間的對抗與合作,較少從治理角度,探討日本如何認識馬賊及處理馬賊危害情形,以及在日本經營滿洲過程中馬賊扮演之角色。本文指出,日本在滿當局於統治前期對馬賊的認識,以及處理馬賊危害事故,主要依據日俄戰時被動掃蕩、調查基礎與條約權限,採取兩面手法,對於未妨害日人利益者,擬善誘利導使馬賊為其所用。日人遇害時,則出動日本軍警,依搜查、懲兇、道歉、賠償模式與中國交涉善後。此一解決模式,僅能就個別被害給予撫慰,難以建立較好的人身保護、遏止犯罪的機制。日方為了緝兇雖出動較多軍警搜查,然在成效有限下,乃將責任歸咎中方。對日本政府而言,日僑的安危固然重要,如何維繫南滿利權、與國際協調進而擴大日本勢力更是擠身國際關鍵。故於裁軍風潮下,以「尊重既成事實」聲明南滿利權係不得變更事項。惟1922年6月新內閣成立後,計畫調整南滿鐵道駐軍,且不顧日僑抗議與陳情,顯見其妥協。
