摘要:
本文分析六起清代死刑執行中發生斬絞混淆的紀錄。其目的除了補強官方規範性文本之不足之處,使我們對清代死刑執行的具體流程與規章有更多的了解外,更重要地,也在於探討死刑差等秩序在執刑過程中遭到破壞的原因及其引發之隱憂的本質為何,並進一步思考清代刑罰思想中「死唯一等」與「斬重絞輕」兩命題間的衝突。
